Background to the Patients' Right to Know Act

In 2023, the governor signed Colorado House Bill 23-1218, the “Patients’ Right to Know Act,” into law. This law protects a person’s right to make informed choices about their health and consent to their medical treatment.

HB23-1218 requires some types of health-care facilities to give you information about certain health-care services they offer. Specifically, the law aims to give you more information about the availability of health-care services and referrals for those services in three categories:
• reproductive health-care services;
• LGBTQ health-care services; and
• end-of-life health-care services.
Some health facilities deny or limit these services for non-medical reasons. For example, a hospital may have a policy that a service is sometimes, but not always, subject to an ethics board review. People seeking health care often do not have information about which facilities have restrictions or limitations. The “Patients’ Right to Know Act” requires certain types of facilities to make that information public by filling out a form. This means you can have the basic information you need to make full and informed health-care decisions.

The answers marked on the Service Availability Form should provide you with valuable information to help you make choices about your care. You can use the contact information on the form to directly contact the health facility for more information about the availability of the services listed on the form.
